These Flobux Terms of Service (the “Flobux Terms”) are a legal agreement between you, as a current or prospective user of the Services, and Evan Carr (hereafter, “Flobux,” "PythoDev," “we,” “our,” or “us”), and governs your use of Flobux, a budgeting tool, which includes mobile applications, websites, software, and cloud-based solutions. If you are using the Service on behalf of a business or entity, you acknowledge and agree that you have authority to bind such business or entity and that such business or entity accepts these terms. By using the Service you agree to be bound by these Flobux Terms.
USER CONDUCT
You are solely responsible for your use of our Services and for ensuring that your use complies with these Flobux Terms and all applicable laws and regulations. You agree not to use our Services for any unlawful or unauthorized purpose or to engage in any conduct that could damage, disable, overburden, or impair the functioning of our Services.
INTELLECTUAL PROPERTY
All content and materials available on our Services, including text, graphics, logos, images, and software, are the property of Flobux or its licensors and are protected by copyright, trademark, and other intellectual property laws. You agree not to reproduce, distribute, modify, or create derivative works based on any content or materials available on our Services without our express written permission.
SUBSCRIBING TO LINKS
Our Service offers subscription plans that allow users to link their bank and credit accounts to our Service.
Terms of Subscribing
By subscribing, you agree that Flobux is not liable for any damages, losses, or issues that may
arise from the exchange of goods and services related to your subscription. Flobux will make every
reasonable effort to ensure the provision of services that correspond to your chosen subscription
plan, but we do not guarantee the availability or functionality of any particular feature or
service. Furthermore, we reserve the right to modify, suspend, or discontinue any aspect of our
Service at any time without prior notice.
By subscribing, you gain access to link your
bank accounts and credit cards through one of our service partners. While Flobux strives to keep
your links active, Flobux also reserves the right to disconnect links at any time, for any reason.
Additionally, Flobux reserves the right to limit the number of new account links beyond your
subscription allowance in a given month.
By subscribing to our Service, you acknowledge
and accept these terms and release Flobux from any liability or responsibility for any issues that
may arise from your subscription or use of our Service.
Refund Policy
You can cancel your subscription at anytime by downgrading to the Free plan from within the Flobux app. Upon downgrading your subscription, you will retain access to the full number of links your plan offered for the remainder of the billing period, and will start your downgraded plan at the beginning of the next billing period. There are no refunds for subscription plans.
CONTRIBUTIONS
Our Service provides opportunities for users to contribute to the development of our Services through voluntary Contributions. By making a Contribution, you agree that Flobux shall not be held legally liable to provide any specific level of service or functionality once the Contribution goal is met. Contributions are voluntary donations given to Flobux to express your interest in certain features, and are not intended to be a transactional exchange of goods or services. While Flobux will make reasonable efforts to provide the features that correspond to the Contribution goals, we make no guarantee or promise to do so. In the event that a Contribution has been made, and Flobux is unable to provide the features designated by the contributor, those funds will be reallocated to other features within Flobux. Please note that Contributions are non-refundable.
DONATIONS
Our Service provides users with the opportunity to make voluntary donations to support the developer. Donations can be made within the Flobux app or through third-party vendors. Any donations made to Flobux are non-refundable and are gifts without any strings attached. The funds provided through donations may be used at our discretion, and we are not obligated to follow any particular direction or advice regarding the use of such funds. We are grateful for any donations made.
DISCLAIMER OF WARRANTIES
Our Services are provided on an “as is” and “as available” basis, without warranty of any kind, either express or implied, including without limitation any warranty for information, services, uninterrupted access, or products provided through or in connection with our Services. We do not warrant that our Services will be uninterrupted or error-free, nor do we make any warranty as to the results that may be obtained from the use of our Services.
LIMITATION OF LIABILITY
In no event will Flobux be liable to you or any third party for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our Services or inability to use our Services, even if we have been advised of the possibility of such damages. Your sole and exclusive remedy for dissatisfaction with our Services is to stop using our Services.
INDEMNIFICATION
You agree to indemnify and hold harmless Flobux, its affiliates, and their respective officers, directors, employees, agents, and contractors from any and all claims, liabilities, damages, costs, and expenses, including reasonable attorneys’ fees, arising out of or in connection with your use of our Services, your violation of these Flobux Terms, or your violation of any rights of any third party.
REVISION AND CHANGES TO FLOBUX TERMS
We reserve the right to modify these Flobux Terms at any time. Any changes will be effective immediately upon posting on our Services. Your continued use of our Services after any such changes constitutes your acceptance of the new Flobux Terms.
